Boston, MA. Yesterday Suffolk Superior Court Judge Geraldine S. Hines, heard arguments today for a Motion seeking to
temporarily restrain Boston's Law and Traffic Enforcement Agencies from enforcing City of Boston Ordinance Docket
Number 0658, which calls for $300.00 fines on (only) motorcycle exhaust equipment not displaying a "readily visible" stamp that the system is approved by the Federal Environmental Protection Agency.
Judge Hines stated she would take their arguments under advisement and issue a decision soon.
Until her decision is rendered, the ordinance remains in effect.
If you ride, or even park your motorcycle in Boston and the EPA labeling is not readily visible, you remain liable
for a $300.00 fine...

0137: Motorcyclists' Rights Advocates to Make Noise ... and Sue City of Boston

(Boston, MA) A group of motorcyclists' rights advocates and activists are putting the final touches on a lawsuit
they expect to file this week in Suffolk Superior Court, asking the Court to restrain the City of Boston from
issuing $300 tickets to motorcyclists and declare a recently rushed through "noise" Ordinance invalid.
Paul W. Cote of Amesbury, Bill Gannon of Quincy, Vince Silvia of Haverhill, Mike Longtin of N. Easton, and Larry Cahill
of Medford, have joined together to rally riders and fight the City of Boston's Docket No. 0658 Ordinance, passed by
the Boston City Council on June 3, and signed by the Mayor June 9th, which reads:
"(a)1) No person shall park, use or operate a motorcycle, within the City of Boston, manufactured subsequent
to December 31, 1982, that does not bear the required applicable Federal EPA exhaust label pursuant to Code
of Federal Regulations Title 40, Volume 24, Part 205, Subparts D and Subpart E.
2) All violations of subsection (a)(1) shall be punishable by a fine of three hundred dollars and no cents ($300.00)...

0136: Slacktivists, Lobbyists, Advocates and Activists: The Farces and Forces of Motorcyclists' Rights

A couple of weeks ago, New Jersey Iron Butt rider extraordinaire John Ryan rode 5,645 miles--from Prudhoe Bay, Alaska
to Key West, Florida--in 86 hours 31 minutes, setting a new record for the IBA's Ultimate Coast-to-Coast ("UCC") run.
John was successful not only because he rode hard, but also because he rode smart. In other words, in addition to
skill, strength and fortitude, he demonstrated his ability to set a goal and implement an effective strategy in
achieving it.
Just as "making the distance" is our goal in endurance riding, "making a difference" should be our goal in
motorcyclists' rights. And in a world of finite resources and conflicting priorities, to make a difference we have
to work smart as well as hard, and do the best we can with what we have. In choosing what we want to accomplish,
and more importantly what we are willing to sacrifice to make it happen, we define ourselves in the spectrum
of the farces and forces of motorcyclists' rights:
SLACKTIVISTS
Quoting from Snopes.com:
"We can't claim credit for having coined this term, nor do we know its actual origin, but we love it nonetheless.
Slacktivism is the search for the ultimate feel-good that derives from having come to society's rescue without
actually getting one's hands dirty, volunteering any of one's time, or opening one's wallet. It's slacktivism
that prompts us to forward appeals for business cards on behalf of a dying child intent upon having his name
recorded in the Guinness World Book of Records, or exhortations to others to continue circulating a
particular e-mail because some big company has supposedly promised that every forward will generate monies
for the care of a languishing tot. Likewise, it's slacktivism that prompts us to want to join a boycott
of designated gas companies, or eschew buying gasoline on a particular day rather than reduce our personal
consumption of fossil fuels by driving less and taking the bus more often. Slacktivism comes in many forms,
but its defining characteristic is its central theme of doing good with little or no effort on the part
of the person inspired to participate, through the mechanisms of forwarding, exhorting, collecting, or e-signing."
This definition applies without exception to more than a few in our ranks. And to it I would add, in the
language if not the words of Jeff Foxworthy, "If you believe that web blogging, forum posting or
email forwarding without real-world followup is 'freedom fighting', then you just might be a slacktivist."

0135: When is it Right to Ride in the Emergency Lane? Or ... How I Ended Up Head Down on a Hood and Handcuffed

A FEW SATURDAYS AGO ... I was riding home to the flat sands of South Florida after a twisting tour through the steep
mountain ridges and narrow winding valleys surrounding Charleston, West Virginia. The weather was comfortably cool
heading south down the WV Turnpike and on through Virginia's Blue Ridge Highlands to Fancy Gap and North Carolina.
But from Mayberry ("Mt. Airy") on, the temperature and humidity rose rapidly as the elevation descended. And by the
time I stopped for gas just south of Charlotte in Rock Hill, South Carolina, my handlebar thermometer was registering
over 100 degrees.
Continuing south on IH-77 through Columbia, I reached its terminus near Dixiana and turned east on IH-26. The
oppressively sweltering heat was making me regret drinking Coke instead of water at my last stop a hundred miles
back, and I was really looking forward to quenching my thirst at the next fill-up. Not long after that, though,
I topped a rise and saw that my next stop would be delayed: There must have been a bad accident ahead, because
before me was a sea of stationary taillights stretching in two lanes to the horizon. Damn! I stopped for a few
moments like everyone else ... but only for a few. I recognized my dry mouth and draining strength as signs of
dehydration. And yes, I admit I had neglected to pack any emergency water that morning, but I decided not to
punish myself for that omission by sitting in the sun and baking on the hot pavement until I passed out.
The emergency/breakdown lane was open, so I...

0134: Open Letter to Bill Davidson: Why Should Motorcyclists Support the MDA?

Dear Bill,
According to this 2009 MDA Harley-Davidson Ride Calendar...
...this year we can once again expect you and the Harley-Davidson Motor Company, through your network of hundreds of
North American dealers and H.O.G. Chapters, to convince thousands of motorcyclists to contribute countless hours
and millions of hard-earned dollars to the Muscular Dystrophy Association. And my question for you is this:
WHY SHOULD MOTORCYCLISTS SUPPORT THE MDA?
According to Charity Navigator, the nation's largest and most-utilized evaluator of charities, the MDA has a
two-star rating with an overall point score of only 46.00:
That two-star rating means the MDA "needs improvement" because their program "meets or nearly meets industry
standards, but underperforms most charities in its Cause". And that means that as the philanthropic Pied Piper
of Chrome Pipes, you and the Motor Company have many more deserving non-biker charities to lure your loyal
customers to than the MDA. This, in turn, leads to my next question...

0133: Open Letter to Lora L. Hunt, Reckless Killer of Motorcyclist Anita Zaffke

Dear Ms. Hunt, On the afternoon of 2 May 2009--the second day of "Motorcycle Awareness Month"--you made the deliberate
decision to engage in the personal vanity of painting your fingernails rather than paying attention to your driving.
In so doing, you knew or should have known that (just as if you were texting or talking on a cell phone) this
deplorable discretionary distraction would transform the possibility of you being in an accident into a probability
of causing one. In so doing, you exhibited a culpable disregard of the foreseeable consequences of your actions,
and recklessly endangered the lives of all motorists who shared the road with you that day. And in so doing, you
wantonly took the life of a helmeted, conspicuously clad, experienced and responsible motorcyclist, a loving wife
and mother named Anita Zaffke: [ http://tinyurl.com/o4hcwv ]
It's too bad Anita Zaffke didn't take the interstate that day. If she had, at least there'd be much less chance
you could have plowed full speed into the rear of her Honda as she waited for a light to change. Instead she was
on an undivided road, where according to NHTSA ( DOT HS 810 606 Table 20 ), 90% of all motorcycle accidents occur.
And why is that? Because those are the roads where motorists guilty of inattentional blindness resulting from
discretionary distractions are most likely to commit a right-of-way violation ... like pulling out or
turning left in front of us as they chat on their cell phones ... or weaving into our lane and hitting us
head on as they tap out their text messages ... or ramming us at a red light while they paint their fingernails.

May is "Motorcycle Awareness Month" ... and here is the only "Motorcycle Awareness Message" you can rely on:
ON ANY ROAD ... an "average person" thinks twice about turning in front of an 18-wheeler, but thinks nothing at
all about turning in front of a motorcycle. WHY? Because an 18-wheeler is larger and "easier to see" than a
motorcycle? Is that why? NOPE! It's because they know violating the right-of-way of an 18-wheeler can KILL
them, but they have little reason to fear violating the right-of-way of a motorcycle.
Perceived danger trumps discretionary distraction...

Don't think for a moment that you were being wooed or recruited by these heels, Heels. YOU WERE BEING HERDED,

May is Motorcycle Awareness Month, and here is a measure of the effectiveness of this annual feel-good campaign:

Despite all the rumors and the City of Myrtle Beach's best efforts to discourage them, next month hundreds of thousands
of motorcyclists are expected to ride or trailer to South Carolina's Grand Strand for "Myrtle Beach" Spring Bike Week
(May 8-17) and the Atlantic Beach Memorial Day Bikefest (May 22-26). Yes, the Carolina Harley-Davidson Dealers
Association claims they are moving their "Spring Rally" to New Bern, NC... http://tinyurl.com/bnvyt3
...but that little burg is only gearing up to handle 3,000 to 4,000 "safe and law-abiding" (which in North Carolina
includes DOT-lidded) motorcyclists: http://tinyurl.com/dxnjxe And according to this website... http://tinyurl.com/dbusro
..."The Carolina Dealers Association, which had a 10 x 30 booth selling t-shirts last year, decided to start an event
in New Bern, NC. This will have no impact on Spring Bike Week in Myrtle Beach. We wish them well in New Bern, but
nothing from Myrtle Beach is moving to New Bern." That means virtually all of those 300,000 to 500,000 riders the
Associated Press referred to will still be headed for "the Strand": http://tinyurl.com/ccejxc
If YOU plan to be one of them, be advised that bikers ... especially BLACK bikers ... are no longer welcome in
Myrtle Beach. And why is that? Here's the official explanation from Myrtle Beach Mayor John Rhodes...

The American Motorcyclist Association ("AMA") is the world's largest and most influential motorcyclists' rights organization ("MRO"). With nearly 300,000 members, their base far exceeds that of the Motorcycle Riders Foundation ("MRF") and all of its ABATE confederates combined. In the Sunshine State, for example, the AMA has five times the membership of ABATE of Florida, an ailing SMRO whose ranks have been thinning for some time now.
One reason the AMA thrives as other MROs struggle to survive is its independence and inclusiveness: It is neither a front for nor subverted by ambulance-chasing attorneys, and it represents all American motorcyclists. The AMA does not discriminate based on age, gender, race, creed, religion, ride or political affiliation. One could say they have lesser tolerance for intolerance than some of their diminutive and declining counterparts. The focus of the AMA is strictly our "Right to Ride". Gold- and yes even Silver-Wingers are welcome, but left- and right-wingers check their non-riding agendas at the door...

The American Motorcyclist Association urges everyone to contact their Senators to vote "No" on H.R. 146, the Revolutionary War and War of 1812 Battlefield Acquisition Grant Program. This bill was formerly known as S. 22, the Omnibus Public Land Management Act of 2009, which would prohibit all motorized vehicle access including motorcycles and ATVs on over 2 million acres of public lands. As you may know, S. 22 was defeated just days ago on March 11 in the U.S. House of Representatives.
Now, following defeat of the bill, the U.S. Senate leadership is expected to employ a little used parliamentary procedure that allows them to overcome the outcome of the House vote on S. 22...

Motorcycle Safety News
February 26, 2009
With more motorcyclists on American roads today than ever, injuries and deaths are also at all time highs, but the man
responsible to help find solutions has been administratively stopped from doing so.
Dr. Samir Ahmed, Professor of Transportation Systems and Engineering at the Oklahoma State University (OSU)
Transportation Center told Motorcycle Safety News he is more than just a little frustrated.
Ahmed is to head the Motorcycle Crash Causation study, a four-year project intended to forensically examine 900-plus
motorcycle accidents over a three-four year period. It is only the second of its type in American history, and has
been described as badly needed. Its data would be used to help reformulate countermeasures and redevelop
training and strategies intended to prevent motorcycle accidents.
But the wheels are turning slowly in Oklahoma...

City of Myrtle Beach began enforcement of a series of new motorcycle helmet, noise, parking and other ordinances
the openly stated intent of which is NOT that bikers be safe, but that bikers be GONE...

Its nobles share allegiance with England. Its clans war with each other." Much the same could be said about the American Bikers' Rights Movement: Many motorcyclists do not consider themselves "bikers"...

The Distribution Chart found on the FACC website will be updated to reflect the amounts for the first and second offenses in the Traffic section. "To evaluate the 2003 repeal of Pennsylvania's motorcycle helmet law, we assessed changes in helmet use and compared motorcycle-related head injuries with nonhead injuries from 2001-2002 to 2004-2005. Helmet use among riders in crashes decreased from 82% to 58%. Head injury deaths increased 66%; nonhead injury deaths increased 25%. Motorcycle-related head injury hospitalizations increased 78% compared with 28% for nonhead injury hospitalizations. Helmet law repeals jeopardize motorcycle riders. Until repeals are reversed, states need voluntary strategies to increase helmet use."

A motorcycle was my exclusive form of transportation long before gas topped four dollars a gallon. And as a 24/7 biker and long distance rider, I use and recommend the use of helmets when riding a motorcycle. On the other hand, I fully appreciate the difference between the utility of helmets and the futility of helmet laws...

A new study reported in the American Journal of Public Health finds that the repeal of motorcycle helmet requirements for adults has been associated with an increase in motorcycle fatalities, beyond the general increase that has been seen throughout the country in the last decade or so. Although the researchers argue that their study reinforces the case for universal helmet laws, the impact they found looks pretty modest:

Since 1975, more than 100,000 motorcycle riders in America have died in crashes. The majority of states required motorcycle helmets in 1975, but today, only 20 states have universal helmet laws that require all riders to wear helmets, 26 states have partial coverage laws (usually only for young riders), and four states have no helmet laws. A recent study by a University of Missouri professor found that the motorcyclist fatality rate has increased in states that repealed their universal helmet laws during the past decade.

America is in a recession, a recession that many say will get worse before it gets better. And although the powers that be waited far too long before uttering the "R" word, there are some who predict the "D" word may apply before year's end. Call it what you will, but thanks to a myriad of factors for which we all are to some degree responsible, our economy is in a mess. And what do our politicos propose as the solution? Why an "economic stimulus package", of course! Free money for everybody! Whoo-Hoo!

Oxford epidemiologist Dr. Bette Liu (email: bette.liu@ceu.ox.ac.uk) is the lead author of a new--i.e. updated--international motorcycle helmet study summarized below. As you might expect, her research confirms the UTILITY OF HELMETS, with which I agree. My concern, however, is that it will be used to perpetuate the FUTILITY OF HELMET LAWS, with which I do not. I ask that you please read the information below, and then:

The National Transportation Safety Board ("NTSB") recently issued a series of press releases and motorcycle safety recommendation letters in which they claimed that increases in motorcycle fatalities have "...outpaced increases in activity measures such as motorcycle registrations". As the chart above clearly shows, that claim is false. Over the last 10 years, motorcycle fatalities have NOT outpaced increases in motorcycle registrations. In fact, the two measures have a near-perfect correlation coefficient of +0.9951.

Life and living encompass many choices. As much as we would like to be, we are not personally in total control of how we live. We live with (and under) rules and regulations (laws) to co-exist peacefully among the population, and along the way develop (hopefully) our internal moral compass to help steer us as we move through life. The essence of Freedom is the possession of choices, to live as we see fit without the bringing of harm onto others. Webster's Dictionary defines freedom (in part) as "1. the state or quality of being free; esp., a) exemption or liberation from the control of some other person or some arbitrary power; liberty; independence; b) exemption from arbitrary restrictions on a specified civil right; civil or political liberty..." Always remember: this is not granted by government; on the contrary--men are "...endowed by their Creator with certain unalienable rights, that among these are Life, Liberty, and the pursuit of Happiness." (as validated in our Declaration of Independence.)

In last month's "Hang Up and Drive!" installment, I pointed out that there are currently 236 million cell phone subscribers on our roadways ... that 73% of them are talking while they are driving ... that cell phone conversations impair their driving skills as much if they were intoxicated with alcohol... and that consequently they are four times more likely to cause or be involved in an accident than motorists who responsibly shut up and steer. And for those of you who discount these statistics--or for whatever reason refuse to accept the fact that cell phone conversation-impaired cagers are one of the greatest and growing threats to the safety of American motorcyclists--I relate the following:
